1. Introduction
These terms govern all installation services provided by The Cotswold Cooking Company (“we”, “our”, “us”) to our customers (“you”, “your”). By booking an installation service, you agree to be bound by these terms.
2. Scope of Work
We will perform installation services as outlined in your order confirmation or quote. Any additional work outside of this scope may be subject to further charges.
3. Customer Responsibilities
To ensure a smooth installation, you must:
-
Provide unobstructed access to the installation site.
-
Ensure the surface where the product will be installed is level and suitable.
-
Confirm all required components are present and ready at the time of installation.
-
Ensure the site is safe and free of hazards.
Failure to do so may result in rescheduling and/or additional charges.
4. Product Condition and Missing Items
We supply products in good faith, with all items documented upon delivery.
-
Any missing components must be reported within 48 hours of delivery.
-
If items go missing after delivery, we reserve the right to charge for replacements.
-
We cannot accept liability for parts misplaced by the customer or third parties post-delivery.
5. Site Conditions
We are not responsible for pre-existing conditions such as:
-
Poorly laid decking, tiles, or groundworks.
-
Slopes, drainage issues, or structural concerns unrelated to our installation.
We reserve the right to halt installation if conditions pose safety concerns or compromise the result.
6. Delays & Additional Visits
If we are unable to complete installation due to issues outside our control (e.g., missing components, poor groundwork, weather conditions), we will need to reschedule. Additional visits may be chargeable.
7. Payments
Payment for installation services must be made in full prior to the confirmed installation date unless otherwise agreed in writing.
All prices are inclusive of VAT unless stated otherwise.
8. Cancellations and Refunds
You may cancel installation with a minimum of 5 working days’ notice. Cancellations made after this period may be subject to a cancellation fee to cover scheduling and preparatory costs.
9. Warranty
Installation workmanship is covered by a 12-month warranty. This does not cover:
-
Damage due to misuse or poor site conditions.
-
Wear and tear or neglect.
-
Issues arising from parts supplied by others or installed by third parties.
Manufacturer warranties on products apply separately and are subject to the terms provided by the supplier.
10. Limitation of Liability
We shall not be liable for any indirect or consequential loss, damage, or expense (including loss of profits or business), except in cases of death or personal injury resulting from our negligence. This aligns with the Unfair Contract Terms Act 1977.
11. Disputes
We aim to resolve all issues amicably. If you are dissatisfied, please contact us immediately. Should a resolution not be reached, disputes may be referred to mediation in accordance with UK consumer dispute resolution protocols.
12. Governing Law
These terms are governed by and construed in accordance with the laws of England and Wales.
